Cover Versions
Cover versions can be quite a confusing area for music artists. We have written the below points as a general guide and overview of cover version rules & requirements.
Note that HitVocals is currently developing a streamlined cover licensing process with international partners to simplify the process of obtaining cover licenses. However, until this solution is finalised, it is the responsibility of the artist & producers to obtain any required permission for releasing cover versions.
For Vocalists
Do I need a license to sell a cover song on HitVocals?
Selling a vocal on HitVocals does not qualify as a "release" of the song and is more akin to being paid a recording session fee, therefore in general, and assuming the lyrics and melody have not been altered, no license is required to sell a cover version on the HitVocals platform.
Note however, that if the lyrics have been modified or melody changed in a substantial way, then you will likely require permission from the original writers and/or their publisher and should therefore seek advice from a music lawyer in this situation.

HitVocals is not responsible for the artist failing to get any such permission where required.
Can I add my name as a songwriter?
In general, the songwriting credit for a song belongs to the original songwriters and copyright owners of the song. These are the individuals who first wrote the lyrics and music for the song and are entitled to receive publishing royalties for its use. If you create a cover version of a song, you are creating a new recording of the song and as a cover artist, you do not have the right to claim a songwriting credit.
However, if you make significant changes or alterations to the original song that go beyond a standard cover version, you may be able to claim a songwriting credit for your contribution. For example, if you rewrite the lyrics or significantly change the melody of the song, you may be able to claim a songwriting credit. In these cases, it is important to consult with a music industry professional or a lawyer to ensure that you are properly credited and that you are complying with all relevant laws and regulations.

In general, it is important to respect the intellectual property rights of songwriters and to properly credit and license their work when creating cover versions or using their songs in any other way. This helps to ensure that songwriters are fairly compensated for their work.
For Producers/Clients
Do I need to obtain a license to release a song bought from HitVocals?
In order to legally release and sell a track that contains a cover version of a song, you (or your label) will need to obtain a license from the copyright owner or their representative, such as a music publisher. This typically involves paying a fee and possibly agreeing to other terms and conditions. Once you have obtained the necessary license, you will be able to sell your version of the song and earn future royalties from the sale of copies or digital downloads.
You may also be entitled to receive performance royalties if your cover version is played on the radio, television, or other public performance outlets.

It is important to note that the specific terms of a license for a cover version, including the royalty rate, may vary depending on the song, the artist, and the market. It is also important to be aware of any applicable laws and regulations related to the use of copyrighted material, such as copyright and trademark laws. If you are planning to create and sell your track, it is a good idea to seek legal advice to ensure that you are in compliance with all applicable laws and regulations.
